David M. Logan, Partner

Mr. Logan is a litigation partner with over 16 years of complex litigation experience. Mr. Logan specializes in complex litigation involving the pharmaceutical, biotechnology, medical device, and health care information technology industries. He brings deep expertise in the legal and business issues facing companies in these areas and has achieved an extensive record of favorable outcomes, with a focus on developing creative solutions to resolve commercial disputes. Mr. Logan represents and advises corporations in a broad range of subject matters including antitrust, unfair competition, class action, contracts, trade secrets, commercial, employment, and products liability.

Mr. Logan has also represented companies in a range of non-health care industries, including telecommunications, energy, banking, automotive, real estate, and food supplements. He has represented corporations in, among other things, price fixing and monopolization cases, wide-ranging disputes involving the cellular telecommunications industry, terminated agent cases, real estate development disputes, and products liability actions involving dietary supplements, industrial products, and automotive manufacturing.

Representative Matters

Representative matters include:

• Managed a 'bet the company' litigation in which shareholder sought corporate dissolution of pharmacy benefits manager and $230M+, achieving settlement during trial for $32M buyout.
• Won three-week trial in breach of contract and breach of fiduciary duty action involving Silicon Valley partnership, and secured post-trial settlement for more than judgment plus all attorneys' fees and costs.
• Represented major pharmacy benefits management company in industry-wide class action alleging conspiracy and unfair practices in nationwide brand-drug pharmaceutical pricing.
• Obtained dismissal of all claims with prejudice in unfair competition class action against major pharmaceutical wholesaler alleging sale of confidential customer information.
• Secured settlement in which client paid nothing in antitrust conspiracy and misappropriation of trade secrets action against medical device manufacturers.
• Devised an innovative strategy to resolve trade secrets and employment action involving a biotech startup company's third employee through return of stock options eventually worth millions.
• Led multi-year post-trial fee and cost proceeding, including two appeals, in antitrust action against major oil company, winning one of largest fee and cost awards in San Diego history.
• Defended cellular telephone carrier in multi-billion-dollar antitrust class action, achieving settlement during trial for small fraction of damages sought.
• Prosecuted trade secrets actions against former sales executives statewide, achieving settlements including multi-year non-compete agreements and permanent injunctions.
• Represented Japanese manufacturer and numerous entities in chain of distribution in 40+ product liability actions involving food supplements, securing numerous favorable settlements.
