MOON Set to Rise March 8, 2017

Beginning March 8, 2017, Medicare-participating hospitals, including critical access hospitals, are required to provide the Medicare Outpatient Observation Notice (MOON) to all Medicare beneficiaries receiving observation services for more than 24 hours. On December 31, 2014, the Internal Revenue Service (IRS) issued its final regulations governing financial assistance policies and community health needs assessments for charitable hospitals.  The regulations are codified in Internal Revenue Code Section 501(r), and apply to all hospitals that are tax-exempt under Internal Revenue Code Section 501(c)(3).  This article provides an overview of some of the requirements discussed in the new regulations, as well as an analysis of how those requirements compare to the state-specific requirements for charity and discounted care established by California’s Hospital Fair Pricing Policies (HFPP) law and the state-specific requirements for community health needs reports under California’s Community Benefit law.
