Emily L. Brinkman is a senior counsel in the Litigation Department of Hooper, Lundy & Bookman. Her practice focuses on a wide range of matters related to hospitals, medical staffs, and other health care providers.
Ms. Brinkman’s broad experience spans federal, state, criminal, and civil defense work. A seasoned litigator, she previously served in the Health Quality Enforcement Section of the California Attorney General’s Office. While there, she tried many cases on behalf of several state health care agencies, including the Medical Board of California, the Podiatric Medical Board of California, and Board of Psychology relating to quality of care, unprofessional conduct, sexual misconduct, out-of-state discipline, and petitions for reinstatement/early termination of probation. She advised clients on investigations prior to bringing disciplinary action and provided training to other attorneys within the Health Quality Enforcement section.
Prior to this, Ms. Brinkman served in the Correctional Law Section (CLS) of the Attorney General’s Office, where she defended the California Department of Corrections and Rehabilitation and its employees in civil rights case brought by inmates. While in CLS, Ms. Brinkman completed several jury trials (state and federal), all with defense verdicts in favor of her clients. She has also argued twice before the Ninth Circuit Court of Appeals. Prior to the CLS, she served in the Mendocino County District Attorney’s Office both as a Victim Advocate and as a Deputy District Attorney.
Ms. Brinkman also acted as the liaison to the Podiatric Medical Board for several years, assisting with revising and updating disciplinary guidelines, legislation, providing training to board members and the medical consultants, and assisting in reviewing licensing applications.
