On October 9th, CMS and the OIG proposed sweeping changes to the Stark Law and the Anti-Kickback Statute regulations. While it will take time for the proposed rules to be finalized (and they may be revised substantially in the process), there are a number of critical takeaways that providers need to be aware of now.
Listen along as HLB attorneys Charles Oppenheim, Ben Durie, and Amy Joseph discuss the most important changes, including commentary clarifying agency policy that impacts how providers should be using the existing exceptions today.
They will provide practical tips for how the changes will affect your day-to-day physician contracting process, describe whether any existing arrangements might need to be restructured if the rules are finalized, and explain how the rules might impact FCA cases based on alleged violations of these laws.
